Renewable Energy Law

J.D. Scanlon & Co LLP provides responsive and commercially focused legal advice on all aspects of property / conveyancing services related to the range of property rights required in association with renewable energy developments to include land acquisition, option agreements, leases, landlord and tenant rights, rights of way/easement/wayleaves, oversail agreements, licences, planning permissions and registration queries that may arise during the course of registering title in Tailte Éireann.

In the past number of years we have acted as lead Irish counsel in relation to a number of renewable energy transactions in both the pre-construction stage and in the acquisition, sale and project finance of operational renewable energy projects.

Project Ronan

J.D. Scanlon & Co LLP provided property law advice in relation to the potential purchase of a 100% interest in one of Europe’s leading integrated renewable energy platforms. This renewable energy platform ultimately sold a 100% equity interest in its Ireland and UK onshore wind business for €571 million.

Project Shine

Project Shine involved the preparation of a Due Diligence report regarding the Real Estate documents and Consents and Planning documents uploaded on a Data-room for the benefit of a potential purchaser which related to windfarm assets in County Offaly and County Wexford.

Project Clear

We acted as lead Irish counsel in the preparation of a Red Flag Due Diligence report with respect to Project Clear.

This work involved the review of property agreements including Leases, Leases of Easements, Grants of Rights of Way, Grants of Easements, Licences, Deeds of Transfer, Option Agreements, Wayleaves, Deeds of Conveyance, Deeds of Assurance and all associated property related documents necessary for the construction, operation and maintenance of the Project.

Our office also reviewed planning documentation including certificates of planning, compliance with planning permission and building regulations, environmental impact statements, felling licences and all ancillary documents which were uploaded on a Data-room for four operational wind turbine projects.
