Marie Gormley

About Marie

Area of Expertise

Marie graduated from National University of Ireland, Galway in 2003, with a Bachelor of Laws (LL.B.) Honours Degree. She also holds a Bachelor of Arts (B.A.) Honours Degree in Legal Science, Sociology and Political Science from National University of Ireland Galway. She was admitted to the Roll of Solicitors of the Incorporated Law Society of Ireland in August 2008, she holds an Advanced Diploma in Data Protection Law from the Honorable Society of King’s Inns.

Prior to joining the firm in 2015, She worked in Dublin practising in the area of Family Law and Conveyancing. In 2017, she completed a Diploma in Healthcare Law with The Law Society of Ireland. In 2018, She attended at the Chartered Institute of Arbitrators in London and completed a course in Mediation. She was appointed a Partner in 2020.

She has a strong record of successfully bringing court applications on behalf of the HSE for orders relating to the administration of medical treatment, detention and protective orders for vulnerable adults. She provides advice in relation to the Nursing Homes Supports Scheme Act 2001 and Mental Health Act 2001 and regularly makes court applications in respect of the treatment and detention for minors in approved centres in Ireland.

She has successfully represented and advised the HSE in the High Court, the Court of Appeal and the Supreme Court in respect of cases challenging the Mental Health Act, 2001 under article 40 of the Constitution. Marie advises various hospitals, clinical professionals and state agencies on a wide array of issues including the Fair Deal Scheme, risk management, patient complaints, confidentiality, clinical governance, data protection issues and day to day operational matters. Marie is appointed to the Decision Making Representative Panel by the Decision Support Service which is a public body established within the Mental Health Commission by the Assisted Decision-Making (Capacity) Act 2015. This role involves making certain decisions on behalf of a person with capacity difficulties.
