Mark Scanlon

Mark is a general practitioner, qualified to practice in Ireland, England and Wales, and operates in all areas of law with particular expertise in the areas of Litigation, Family Law, Mental Health Law and Employment Law.

Mark provides timely, accurate advice to the Health Service Executive, private nursing homes and private voluntary hospitals in relation to mental health law, the law in relation to capacity and data protection law.

About Mark Scanlon

Area of Expertise

Mark graduated from University College Dublin with an honours degree in Business and Legal Studies (European) in 2012 before completing his legal training in a large firm in Dublin. Mark was admitted to the roll of solicitors in 2016 and joined J.D. Scanlon & Co in 2018. In 2021 Mark successfully completed a diploma in Healthcare Law with the Law Society of Ireland.

Mark advises hospitals, clinical professionals, nursing homes and private clients on areas including the Fair Deal Scheme, data protection, employment law disputes and debt collection matters.

In 2022, Mark was appointed to the Decision-Making Representative Panel by the Decision Support Service which is a public body established under the Mental Health Commission under the Assisted Decision-Making (Capacity) Act 2015. Mark is extremely familiar with the provisions of the Assisted Decision Making (Capacity) Act 2015 and advises his clients in relation to the creation and registration of enduring powers of attorney, healthcare directives and decision-making support options under the 2015 Act.

Mark was appointed by the Mental Health Commssion as an independent legal representative in 2025. In this role, he is regularly appointed to act at Mental Health Commission tribunal hearings on behalf of persons detained in approved centres.

Mark has extensive experience in personal injuries litigation and has represented both plaintiffs and defendants in the District Court, Circuit Court, High Court and Court of Appeal. Mark has successfully represented clients at mediation talks which have resulted in seven figure settlements for his client.

Mark has represented claimants and respondents, both with and without counsel, in the WRC.
